The idea behind the key

A trust is an empty safe. You hold the keys.

Your trust only holds anything after you pass, and you leave the keys, your instructions, for how it should be shared. There is no yearly charge, and you can change those instructions any time without rewriting your Will.

Could care costs take your home?

In Northern Ireland, if your assets are above £23,250 you pay for your own care, and nursing homes can run from £1,000 to £1,500 a week. With the right trust and the correct ownership of your home, tenants in common rather than joint, you can protect your home and savings and still look after your partner.

Plain English

Questions I get asked all the time.

No. Picture your trust as an empty safe. It only holds anything after you pass, and you leave the keys with your instructions. There is no annual charge.
That is the beauty of a discretionary trust in your Will. You leave instructions on how things should be shared, and you can update them any time, without rewriting your Will.
With joint ownership, when one partner dies the other owns the whole home, which can then be at risk. As tenants in common you each own a share, so you can leave your half to whoever you choose while protecting your partner.
We recommend everyone has one. Lose capacity without an EPA and a court decides who manages your affairs, not your family. It may never be needed, but the consequences of not having it can be serious.
Your signed original is stored safely, and we record it on the National Will Registry as standard, so it can always be found.
